Backdated Sick Notes: Up to 3 Days Back
The short answer: up to three days back is possible, as an exception, after careful medical assessment, not as a rule. This page sets out what it depends on, when backdating is defensible and when it is not.

Can a sick note be backdated?
Yes, within narrow limits. Section 5 (3) of the incapacity guideline issued by the Federal Joint Committee provides that the start of incapacity for work may be backdated, „only exceptionally and only after careful assessment and as a rule only by up to three days".
The normal case remains: a certificate starts on the day the doctor examines you. Backdating is the justified exception to that, not an entitlement. Whether it is defensible in an individual case is decided by the doctor during the consultation.
The three-day limit was deliberately raised from two to three days in 2016. The reason was exactly the situation that brings most people here: you fall ill at the weekend and practices only open again on Monday.
When is backdating defensible?
The doctor has to be genuinely able to assess the incapacity for work for the past days. That works for an illness that is still showing and whose course can be traced, for example fever, a cough or a stomach infection that started on Saturday and is still there on Monday.
Second, it has to be understandable why contact with a doctor was not possible earlier. A weekend, a public holiday or the night are such reasons.
Backdating is not defensible if all that is described is a past state that can no longer be seen today. There is no medical basis for a finding then, and a certificate without a basis is not a favour but a legal problem for both sides.
Does this work by video consultation too?
The guideline does not distinguish between an examination in the practice and one by video. What matters is whether the doctor can form their own impression, and in a live video consultation with picture and sound they can.
What does not work by video either: assessing symptoms that have completely subsided. What the doctor cannot see and cannot trace, they cannot certify.
A labour court in Erfurt expressly recognised a private certificate issued by video as full proof (ArbG Erfurt, 4 Ca 32/23). What courts do reject are certificates based solely on an online questionnaire without any contact with a doctor.
What applies to longer periods?
The further back the start lies, the heavier the risk weighs for you. Labour courts generally regard the evidential value of a certificate backdated by more than two days as shaken (LAG Rheinland-Pfalz, 8 Sa 373/14), and the employer can then question continued pay.
No careful doctor issues a certificate backdated by a week or even several weeks. A professional court reprimanded a doctor who had backdated a certificate by two weeks even though the symptoms rested solely on the patient's account.
In short: one to two days is the unproblematic range, three days the exception with reasons, anything beyond that no.
How many days can a doctor backdate a sick note?
The answer depends on the distance, not on goodwill. One day back is the unproblematic case: someone who fell ill yesterday and sees a doctor today usually gets the previous day certified as well, if the account fits the findings.
Two to three days is the exception expressly provided for in section 5 (3) of the incapacity guideline, „only exceptionally and only after careful assessment". That range covers the weekend, and it is why the limit was raised from two to three days in 2016.
Four days, five days, two weeks: no careful doctor issues that. Not out of convenience, but because they would have to certify a condition they could not assess, and because such a certificate is worth little before a labour court anyway.
Whether one, two or three days is defensible in an individual case is decided by the doctor alone during the consultation. There is no entitlement to a particular start date.

Is a doctor allowed to backdate at all?
Yes. Backdating is expressly regulated and not a grey area; it is set out in the incapacity guideline of the Federal Joint Committee, the very rulebook that panel practices follow.
What the doctor may not do is certify incapacity for work for a period they cannot assess. That is why they ask: since when the symptoms have existed, how they developed, what you did in the meantime. If the picture fits, backdating can be justified. If it does not, the day of the examination stands.
This does not apply to a follow-up certificate: it follows on from the previous one without a gap and is not backdated. Anyone who needs an extension should present themselves before the current certificate runs out.
What should you do regardless?
Report sick to your employer without delay, if you have not already. Reporting sick is independent of the certificate and should happen on the first day of illness; that is the duty under section 5 (1) of the Continued Remuneration Act.
Many employers only require the certificate itself from the fourth day of illness. It is worth looking at your employment or collective agreement, because earlier presentation may be agreed there.
